4. Digital Products

• All Digital Product purchases are non-refundable.
• Digital Product licenses are revocable, non-transferable, and not for resale.

5. Software-as-a-Service (SaaS) Subscriptions

5.1 Billing

• Subscriptions may be billed monthly, annually, or according to a plan-specific billing cycle.
• From time to time, we may offer free trials. If a free trial is provided, it may automatically convert to a paid subscription unless canceled before the end of the trial period.

5.2 Cancellation

• You may cancel your subscription at any time.
• Cancellation will stop future charges only.
• Fees already paid for the current billing period are non-refundable.

5.3 Account Suspension and Termination

We may suspend or terminate your access to the SaaS Services for reasons that include, but are not limited to:

• Violation of these Terms;
• Non-payment;
• Abuse, spam, or illegal activity; or
• At our discretion, with reasonable notice where feasible.

6. Done-For-You (DFY) Services & Consulting

We offer services including, but not limited to: SEO and paid advertising management, content creation and content marketing, strategy consulting, email marketing, funnel and campaign development, branding, creative services, and automation setup ("DFY Services").

6.1 Separate Service Agreements

DFY Services are governed by one or more separate written agreements, statements of work, or service contracts (collectively, "Service Agreements"). These Terms supplement and do not replace any such Service Agreements. In the event of a direct conflict, the Service Agreement will generally control for the specific DFY engagement.

6.2 Payment for DFY Services

DFY Services may be billed as:

• Upfront payments;
• Monthly retainers;
• Milestone-based payments; or
• A combination of the above, as specified in the applicable Service Agreement.

6.3 Refunds for DFY Services

Unless expressly stated otherwise in a written Service Agreement, all payments for DFY Services are non-refundable.

6.4 Ownership of Work

Unless otherwise agreed in writing, DFY deliverables become the client’s property once all related fees are paid in full. We may retain copies for portfolio, archival, or legal purposes, subject to confidentiality obligations.

7. User-Generated Content

Our website may allow users to submit comments, reviews, testimonials, or other content ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content in connection with our business, subject to applicable law.

You agree that you will not submit User Content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or fraudulent;
• Infringes any intellectual property or privacy rights of others;
• Constitutes spam or unauthorized advertising; or

14.2 No Class Actions

Notwithstanding the foregoing, either party may bring an individual action in a small claims court located in the State of California if the claim is within that court’s jurisdictional limits.

16. Termination

We reserve the right to suspend or terminate your access to the website, Digital Products, SaaS Services, or DFY Services at any time, with or without notice, if we believe you have violated these Terms, failed to pay fees when due, engaged in abuse or illegal conduct, or for any other reason at our reasonable discretion.

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Any provisions of these Terms that by their nature should survive termination shall so survive, including, without limitation, intellectual property provisions, warranty disclaimers, limitations of liability, and indemnity.

We may revise and update these Terms from time to time in our sole discretion. All changes are effective when posted and apply to all access to and use of the website and services thereafter.
